With the entry into force of Law 34/2026, smart working officially becomes part of workplace health and safety regulations in a much stricter way.

An obligation that until yesterday existed mostly on paper has now been incorporated into the Consolidated Law on Workplace Safety and is subject to penalties. In practical terms: providing information on the risks related to remote work is now a concrete responsibility for employers.

What changes for companies

Until now, many companies managed this topic as a mere formal requirement. From today, the situation is different. Employers must:

provide written information on the risks related to remote work
deliver it at least once a year to both the employee and the Workers’ Safety Representative (RLS)
update it according to working conditions.

And most importantly, failure to provide this documentation may result in penalties.

👉 Or a fine of up to €7,403.96
